Due to the current drought situation, the period of prohibition of forest and agricultural burning between May 1 and September 30 expands (08/05/2014)

The City Council of Alhama de Murcia, through its departments of Environment and Agriculture, reports the decision of the Directorate General for the Environment by the period of forest fire danger is magnified.

This order reads as follows:

Resolution of the Directorate General for the Environment by expanding 2014 the period of danger and the force and effect of burning authorizations issued pursuant to the Order of May 24, 2010, the Ministry of suspended Agriculture and Water, on prevention of forest fires in the region of Murcia in 2010.

On May 28, 2010, is published in the Official Bulletin of the Region of Murcia Order of May 24, 2010, the Ministry of Agriculture and Water on prevention of forest fires in 2010 (n BORM. 121 of 28 May), whose term is automatically extended for successive annual installments until the present, in accordance with the provisions of the Fourth Additional Provision.

Article 9 of the Order generally prohibits the performance of agricultural and forest fires in the time of danger excepcionándose within this period, prior authorization, and secure the months of July and August when burning aimed at preventing or mitigate damage from pests, diseases, or avoid other more serious risks under extraordinary preventive measures dictated by the Directing Center.

In turn, the additional second of that order, provision states that where there are social reasons, particularly bad weather or other reasons so warrant, authorizations issued under the Order may be temporarily suspended in full force and effect , until no such reasons or motives.

With such a basis, the part of the Planning, Protected Areas and the Defense of the Natural Environment Management Centre has prepared a report dated April 23, 2014, under which special and adverse weather conditions in recent months the region, as well as those of this spring season, justifiably require temporarily suspend the force and effect of licenses already issued for burning based on the aforementioned Order, until the adverse conditions disappear.

Similarly, the first final provision allows the modification of the time of danger as defined in art.

3 of the said Order, having been proposed by the competent service advancement thereof, including 2014 May, given the special adverse conditions of drought and forest fuel moisture stress, which significantly favors the evolution refusal of a possible outbreak of fire.

HAVING SEEN the background expressed, the requirements contained in the Order of May 24, 2010 of the Ministry of Agriculture and Water on prevention of forest fires in 2010 (n BORM. ° 121 of 28 May) and established in Law 43/2003 of 21 November, Forestry, in particular Article 43 thereof relating to the adoption of measures aimed at preventing, detecting and suppressing forest fires whatever the ownership of the mountains, the Regulations of the Law 81/1968, of 5 December, in its provisions, the Law on the Legal Regime of Public Administrations and the Common Administrative Procedure, and others that are applicable, the Directorate General in exercise of the powers conferred on it

Solve

First, larger 2014 period of risk referred to in Article 3 of the Order of May 24, 2010, the Ministry of Agriculture and Water, which is established in the period between May 1 and on September 30.

Second: temporarily suspend the force and effect of permits for agricultural and forest burning issued on the basis of the Order of May 24, 2010, the Ministry of Agriculture and Water, until the bad weather away.

The agreed temporary suspension will have no effect in respect of those authorizations that the Directorate General of Environment was able to dictate in order to prevent or mitigate damage caused by pests, diseases or avoid other more serious risks under extraordinary preventive measures.

Third: Suspend the force and effect of authorizations for use of fire in recreational areas or similar plant fuel.

Fourth: Notification of this resolution to stakeholders.

Fifth: This resolution shall be published in the Official Bulletin of the Region of Murcia for general knowledge.
