Motion City Group UI + Greens to full council on: Solidarity with Judge Baltasar Garzón (18/03/2010)

Many citizens are following with extreme concern the situation that is occurring in relation to the Supreme Court's action, by reason of breach of trust charges against Judge Baltasar Garzon.

Apart from other considerations on the work of Judge Baltasar Garzon, it seems surprising that it was suspending open a file based on the admissibility of a criminal complaint filed against it by court action to try to investigate the crimes of the Franco-barred , and another for attempting to leave without value of evidence obtained in the investigation of the case Gürtel.

Caused indignation and embarrassment to see how instead of encouraging the prosecution of crimes committed under Franco against many citizens of our country, pursuing those who try to contribute to justice, it's amazing that protects the perpetrators and leave again more victims.

It is equally surprising that it seeks by continuing criminal complaints, undermining the judicial effort to try to clarify cases of corruption as the case Gürtel, trying to protect corrupt practices, limiting the possibility of research.

To continue the processing of Judge Garzon would jeopardize the investigation of the case and planted Gürtel way of impunity for those currently involved

These proceedings brought by the fields on the right and the extreme right of our country, the authors of criminal complaints admissible, inadmissible pulse are a democracy and justice in our country that should not be covered by government bodies of judges.

What is happening in this case is not just an action against a judge who, in exercising its functions, initiated proceedings in the field of competence and within the powers assigned to it but what moves all citizens in this country is that there are issues and people that are untouchable and to act against them is, even today, serious consequences for them.

We believe the campaign of harassment and demolition being carried out by sectors of the extreme right and the right of our country is really unacceptable in a democracy, trying to undermine judicial independence and intends to send a message to all the people that there unwritten limits to the course of justice and democracy.

Not surprisingly, Democrats from around the world and national legal organizations and international human rights have been shocked by this campaign and have expressed their solidarity with the judge Baltasar Garzón.

For all this and resolve pending legal proceedings against Judge Garzon, this should not be suspended from their duties, should continue to take decisions that cast doubt on the impartiality of the Government of the Judges and the Supreme Court.

For all the above is proposed that the full council to adopt the following

AGREEMENTS

1 º show solidarity and support of Judge Baltasar Garzon, to the campaign of harassment and demolition that is being submitted.

2 º Require the General Council of the Judiciary to act with absolute impartiality in this case without a decision of suspension of the functions of judge Baltasar Garzon as long as there are no judgments in relation to the facts alleged against him.

3 º Requiring victims of Franco who urged the initiation of legal proceedings opened by the crimes of the Franco regime to become party to legal proceedings initiated against Judge Baltasar Garzon of the Supreme Court.

4 ° Ensure that procedures for corruption, investigated so far by Judge Garzon to continue and expand the scope of investigation to clarify the criminal liability that would place.

5 That this Agreement shall transfer to the President of the General Council of the Judiciary.
