Information on the measures included in the Royal Decree regarding housing rental (02/04/2020)

Information on the measures included in the Royal Decree Law 11/2020, approved by the government and published in the Official State Gazette, regarding housing rental COVID-19.

EXTENSION OF RENTALS

Rentals that end between April 1 and until the day that two months have elapsed since the end of the state of alarm can be extended at the request of the tenant for a period of up to 6 months, subject to the same conditions.

RENTAL AID

Requirements: have the condition of being in Economic Vulnerability.

Both criteria must be met:

Go to be in a pair (we understand that previous unemployed are not), in ERTE or have had their working day reduced in case of being an entrepreneur with loss of income, and that the Family Unit (the registered people in the house) do not enter more than 3 IPREM ( € 1,613.52) a little more per child and in cases of disability.

That the rent, plus basic expenses and supplies, is greater than or equal to 35 percent of the net income of the family unit.

For these purposes, "basic expenses and supplies" shall mean the amount of the cost of supplies of electricity, gas, diesel for heating, running water, fixed and mobile telecommunication services, and possible contributions to the community of owners .

In other words, expenses exceed € 564.73.

In the case of large owners (11 or more dwellings / premises or more than 1,500 m² built, the tenant may:

Request until May 4 the deferment of the rent payment of up to 4 monthly payments, the owner must respond in 7 days offering:

A 50% discount those 4 months.

A deferral of these 4 monthly installments to be prorated in the following 36 months unless the contract is of shorter duration and must be adjusted to that period.

Apply for transitional financing aid (measure not compatible with the previous one).

In the case of small landowners (up to 10 homes / premises) there is no mandatory rule, the agreement, if any, is left to the parties and only offers the option via loans of transitory financing aid.

The procedure requires the presentation of documentation but if the applicant for the moratorium is unable to provide any of the required documents, he or she may substitute it by means of a responsible declaration, and must present them later because if they do not do so, they will be responsible for any damages that may have occurred, as well as all the expenses generated by the application of these exceptional measures, without prejudice to the responsibilities of another order to which the conduct of the same could give rise.

The transitional financing grants will consist of banks being able to offer loans to people in vulnerable situations, with a repayment period of up to six years, without any expenses and interests for the applicant.

Lastly, it establishes a second coverage, to be determined by the Autonomous Communities, for those families that cannot face the payment of those loans for the payment of the rent will have the purpose of facing the difficulty in repaying those grants. transitory financing contracted by vulnerable households that have not recovered from their vulnerable situation as a result of the COVID-19 crisis and, therefore, cannot cope with the repayment of said loans.
