Ecologists in Action of the region of Murcia has expressed surprise and indignation at the statements of the Minister of Tourism, Pedro Alberto Cruz, announcing the imminence of the land reclamation project at Paramount in Alhama de Murcia, assuming that the project will receive all permits and in record time.
And, for the environmental association, there are two very serious issues to consider in this announcement:
First, both the City of Alhama, as the Director himself Cruz, they can commit a crime of trespass, if they encourage and allow the works begin to occur before the project has all necessary permits, including include the Environmental Impact Statement and local planning permission (subject to obtaining positive DIA).
For the association, acting by means of the fait accompli, and immoral is illegal, and could have legal consequences for both project developers and for public office involved and even the technicians who by act or omission permitted.
Also, in the unlikely and hypothetical case in such a short period of time the project will have all necessary permits, this would reflect that have not been taken into account legal and environmental issues raised by Ecologists in Action in their submissions to the Special Plan Paramount.
In that case there would be another source of complaint for alleged trespass against specialists and leaders of the City and of the Autonomous Community, by knowingly approve a development plan that violates the law.
And, remember the environmentalists, the recent Constitutional Court ruling reinstated Regional Park boundaries "Carrascoy and El Valle", affecting 21% of the surface of the Special Plan Paramount, which represents a substantial change of the project, judgment of the association, and therefore require restarting the whole procedure and process of public exposure.
Remember that urban environmental processing and are not mere forms to fill out to get a license.
Legal procedures are used to ensure the interest of all citizens from the private interest of companies and individuals.
When acting by way of the fait accompli, it is undermining a constitutional right of all citizens, which is even worse when it encourages and protects them from public institutions should ensure that the general interest, as required by Democratic Constitution of our country.
And is that environmentalists claim that this type of reckless and irresponsible announcements made by our leaders, are precisely those who have contributed to "educate" employers and individuals in the culture of "anything goes in the name of the business" and that the media environment and the general lack of importance whenever there is a lucrative business in between.
For Ecologists in Action is extremely unethical and irresponsible to feed the public institutions, business expectations, whether legitimate or not, business owners and, assuming that a project will be carried out or yes, without waiting for the completion of the environmental and urban processing and accidentally contemplate can not obtain all permits, and therefore the project is not legally viable.
If one adds the permissive path against the fait accompli, so sadly common in our country, is that the administration itself is the worst enemy of general interest and current legislation, when theoretically should be your biggest advocate.
Given the gravity of the situation created by local and regional governments, Ecologists in Action has wanted to send a warning to technicians, public office with responsibility and project developers:
If any work is started Paramount project without each and every one of the necessary licenses and permits, and / or not in accordance with current legislation regarding judicial decisions that restore Regional Park boundaries, and do not allow teleportation This association announces that lodged legal action against company, technical and public officials with responsibility to allow this to happen.
